Blue-Mobility is responsible for the promotion, communication, invoicing, administration and day-to-day operation of the fiets bike-sharing scheme \u2018Blue-bike\u2019. <\/p>\n<p>Questions regarding the protection of personal data can be sent via <strong><a style=\"color: #0078a3;\" href=\"https:\/\/blue-bike.be\/nl\/contact\">the online contact form<\/a><\/strong><strong><\/strong>or directly in an email to <strong><a style=\"color: #0078a3;\" href=\"mailto:info@blue-bike.be\">info@blue-bike.be<\/a><\/strong>. <\/p>\n<p>Blue-mobility safeguards the privacy of its customers and in this context always acts in accordance with the provisions of the General Data Protection Regulation (<i>GDPR 2016\/679 of 27 April 2016).<\/i><\/p>\n<h3><b>2) What data is collected and why?<\/b><\/h3>\n<p>Blue-Mobility processes personal data of its Primary Accounts and Sub-accounts to which a Membership has been linked for the following reasons: <\/p>\n<ul><li>Cancelling Memberships <\/li><li>Delivery of Blue-bike cards <\/li><li>Delivery of Blue-bike invoices <\/li><li>Allocating Blue-bike vouchers <\/li><li>Provision of necessary information such as changes to the tariff <\/li><li>Answering questions from Main Accounts and Subaccounts <\/li><li>Market research and market analysis <\/li><\/ul>\n<p>Blue-mobility collects various data upon the registration of Main Accounts and Subaccounts, including standard personal data (for the Main Account: name, address details, date of birth, telephone or mobile phone number, IBAN bank account number, email address; for the Subaccount: name, email address). Providing all of this personal data is necessary in order to use a Blue-bike. For business customers (cf. business Membership), the company registration number is also requested. <\/p>\n<p>The data are used to process requests and orders or to provide the necessary services or assistance. They may also be used for surveys and evaluations (subject to newsletter subscription) as well as for emails regarding roadworks, faults or tariff changes. Blue-mobility may also anonymously archive data concerning, inter alia, travel behaviour, locations and times of travel without any restriction. In such cases, Blue-mobility ensures the anonymity of this data. Market research and market analysis are conducted using the collected data. <\/p>\n<p>Blue-mobility uses market analysis to implement target group policies, for example, to apply price differentiation, and to align supply with demand as closely as possible. In addition, the analyses are also used to optimise accessibility. Personal data is not used on an individual level, but is always anonymised before being used in the context of market research. <\/p>\n<h3><b>Location data<\/b><\/h3>\n<p>Blue-mobility collects and processes location data of the User of a Blue-bike when the User rents a Blue-bike that is equipped with a digital lock. By renting a Blue-bike equipped with a digital lock, the user agrees to the collection and processing of the location data of the relevant journey. <\/p>\n<p>The location data is collected via the Blue-bike app. Every time a user unlocks or locks the digital lock of a Blue-bike via the Blue-bike app, the location data is logged in Blue-mobility's systems. The ride itself is not tracked. <\/p>\n<p>During journeys on e-bikes, the bike\u2019s location data is transmitted to Blue-mobility\u2019s systems at regular intervals throughout the journey. This makes it possible to determine the route taken by the bike. Blue-mobility will not access the location data from the journeys except in exceptional circumstances, such as when a bike has been lost or stolen. The anonymised journey data may be shared with third parties, such as a city or local authority, for the purposes of developing mobility policy. <\/p>\n<h3><b>4) Emails via contact form<\/b><\/h3>\n<p>The Blue-bike website has a contact form, through which questions or comments can be sent to an inbox. When sending the message, the User of the contact form agrees that Blue-mobility will use the provided details (including name and email address) to contact the User of the contact form, solely for the information requested by the User on the contact form. These emails will be kept for as long as, but no longer than, Blue-mobility considers necessary to guarantee a correct service. <\/p>\n<h3><b>5) Newsletters<\/b><\/h3>\n<p>Newsletters are only sent subject to explicit consent from the Master Account. The Master Account can adjust their newsletter preferences in a personal online account at <strong><a style=\"color: #0078a3;\" href=\"http:\/\/www.my.blue-bike.be\/\">www.my.blue-bike.be<\/a><\/strong>. Non-members can also sign up for the newsletter via <strong><a style=\"color: #0078a3;\" href=\"https:\/\/blue-bike.be\/en\/\">www.blue-bike.be<\/a><\/strong> and can also unsubscribe at any time. <\/p>\n<h3><b>6) Who receives this data?<\/b><\/h3>\n<p>Blue-mobility may transfer certain personal data to subcontractors who act as processors of personal data on behalf of Blue-mobility. In such cases, they are only granted access to the data that is necessary to perform their assignment. <\/p>\n<p>If the Membership Holder makes use of a Blue-mobility Partner Benefit in collaboration with one or more partners, it is possible that one of the conditions for benefiting from the offer is that the Membership Holder agrees to be contacted by Blue-mobility or the partner in question; or that certain personal data, such as fiets usage, be shared. Where applicable, the Membership Holder agrees that Blue-mobility may disclose certain personal data to the partner in question, if necessary. Where this is the case, it will always be explicitly stated when taking part in a promotional offer. <\/p>\n<p><b>7) The rights of the data subjects<\/b><\/p>\n<p>Blue-mobility protects the privacy of its customers and in this context always acts in accordance with the provisions of Regulation (EU) 2016\/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95\/46\/EC (General Data Protection Regulation), hereinafter referred to as the \u201cGDPR\u201d. <\/p>\n<p>By providing their personal data via the Blue-bike website or via the Blue-bike app, the user of the Blue-bike website or the Blue-bike app explicitly grants permission to Blue-mobility to process this data for the stated purposes upon acceptance of the stated cookies. As a data subject, the User has the right to access, rectify or, if he\/she has no ongoing Membership or outstanding payments, erase the personal data, in accordance with the GDPR. The data subject can adjust, view or modify their data by contacting us via the contact form or via <strong><a style=\"color: #0078a3;\" href=\"mailto:info@blue-bike.be\">info@blue-bike.be<\/a><\/strong>, subject to proof of identity. <\/p>\n<p>Personal data will also be transferred to competent authorities such as the Public Prosecution Service, examining magistrates and\/or police services when this is necessary within the framework of the detection, investigation or prosecution of offences. <\/p>\n<p>Regarding the processing of personal data, the data subject has the right to lodge a complaint with the <i>Data Protection Authority<\/i>, 35 Drukpersstraat, 1000 Brussels. <\/p>\n<h3><b>8) How are the data secured?<\/b><\/h3>\n<p>Blue-mobility ensures the proper security of the applications in which personal data and passwords are processed, as well as the infrastructure on which these applications are deployed.
