Terms and Conditions from 1st of July 2026

These new terms and conditions will apply from July 1, 2026. Until then, our current terms and conditions remain in effect.

These general terms and conditions relate to the services supplied under the Blue-bike brand by Blue-mobility NV.

The use of a shared bicycle shall imply that the user has read these general terms and conditions and accepts them without reservation.

1. Definitions

1.1 User

Any natural person using a bicycle supplied by Blue-mobility under the Blue-bike brand.

1.2 Blue-bike / Blue-bike shared bicycle

A bicycle rented out by Blue-mobility at a Blue-bike location. Blue-mobility offers different types of bicycles under the Blue-bike brand: city bikes, e-bikes and cargo bikes. Where the distinction is not relevant, the term ‘Blue-bike’ shall be used in these terms and conditions.

All Blue-bike bicycles are equipped with smart locks that the user can unlock via the Blue-bike app.

1.3 Blue-bike location

A location where a Blue-bike can be rented and where the user can start and/or end a trip.

1.4 Blue-bike app

The Blue-mobility mobile application, which can be downloaded free of charge from the Google Play Store or the iOS App Store and is required in order to rent a Blue-bike at a Blue-bike location.

1.5 My-Blue-bike application

The secure web portal available at my.blue-bike.be, which the user can access using their account. The portal incorporates a number of account management features.

1.6 Blue-bike account

The e-mail address used to access the Blue-bike app and Blue-bike web portal following registration. Blue-mobility distinguishes between business and private accounts.

1.7 Business account

If registration in the app is performed within the context of the economic activity of an organisation registered in accordance with the law in the Crossroads Bank for Enterprises (CBE), the user representing that organisation must create a business account.

1.8 Private account

If registration in the app is not performed within the context of the economic activity of an organisation registered in accordance with the law in the Crossroads Bank for Enterprises (CBE), the user must create a private account.

1.9 Sub-account

A sub-account is an account created via the portal by the administrator of a business account for a user who is associated with the organisation.

A sub-account is automatically registered for the user who creates a business account.

1.10 Administrator

The user who creates a business or private account is assigned the administrator role in the My-Blue-bike application. The administrator of a business account has additional features available in the My-Blue-bike application via their sub-account.

1.11 Voucher

A voucher is a digital token that can be purchased by an administrator via the portal. A voucher represents the right to use a bicycle of a specific type once, for a defined period, provided that the voucher has not expired. A company may provide vouchers to users associated with its organisation. Vouchers may also be distributed as part of promotional campaigns or through partnerships.

1.12 Payment agreement

When creating a private or business account, a payment agreement will be set up. The payment agreement specifies the payment method agreed between Blue-mobility and the company or between Blue-mobility and the private user for the payment of any costs related to the use of Blue-mobility’s services.

1.13 Blue-bike MAAS ticket

Blue-mobility has entered into agreements with various MaaS (Mobility-as-a-Service) providers to allow these providers to sell Blue-bike MaaS tickets to their customers.

A MaaS ticket is a digital token with a limited validity period, which may differ for each MaaS provider. A Blue-bike MaaS ticket entitles the MaaS customer to rent a Blue-bike of a specific type for a defined period in accordance with these general terms and conditions.

1.14 Contracting party

The party with whom Blue-mobility has entered into an agreement with regard to the use of the services offered under the Blue-bike brand:

  • the private individual who has created a private account;
  • the organisation for which a business account has been created;
  • MaaS providers with whom agreements have been concluded.

1.15 Consumer

A natural person acting for purposes outside their trade, business, craft or professional activities, as referred to in Article I.1, 2° of the Belgian Code of Economic Law.

If and insofar as a contracting party also qualifies as a consumer, the mandatory provisions of consumer law shall prevail over these general terms and conditions.

1.16 Blue-bike pricing formulas

In order to rent a Blue-bike using an account, the account must be linked to a Blue-bike pricing formula.

For a private account, the user selects their pricing formula in the app.

For a business account, the administrator determines the pricing formula for the created sub-accounts via the company portal.

Blue-bike offers the following pricing formulas:

  • Blue-bike Ticket
  • Blue-bike Member
  • Blue-bike Member Plus
  • Blue-bike Member Plus E-bike

The cost of the different pricing formulas and corresponding fares are set out in the tariff list and can be consulted in the app and on www.blue-bike.be/en.

1.16.1 Blue-bike Ticket

The user can rent a Blue-bike using their account without any recurring monthly or annual charges.

1.16.2 Blue-bike Member

The user can rent a Blue-bike for a limited recurring (monthly or annual) fixed fee, whereby the ride fare is generally lower and never higher than the ride fare under the Ticket formula.

1.16.3 Blue-bike Member Plus

The user can, for a recurring (monthly or annual) fixed fee, make an unlimited number of trips with a single city bike, free of charge for trip durations up to 12 hours.

1.16.4 Blue-bike Member Plus E-bike

The user can, for a recurring (monthly or annual) fixed fee, make an unlimited number of trips with a single city bike or single e-bike, free of charge for trip durations up to 12 hours.

1.17 Back-to-many zone

A geographically defined group of Blue-bike locations within which a trip can be ended without surcharge, provided that the trip was started within the same zone, as indicated in the Blue-bike app.

2 Modalities

2.1 Conclusion of the agreement

2.1.1 A user may register an account in the app provided they have reached the age of 18.

2.1.2 If registration in the app is completed within the context of the economic activity of an organisation registered in accordance with the law in the Crossroads Bank for Enterprises (CBE), the user representing that organisation must create a business account.

2.1.3 If registration in the app is not completed within the context of the economic activity of an organisation registered in accordance with the law in the Crossroads Bank for Enterprises (CBE), the user must create a private account.

2.1.4 The creation of the account shall only be complete and ready for use once the selected payment methods have been validated by Blue-mobility and the applicant has confirmed their e-mail address via the link contained in an automated e-mail from Blue-mobility.

2.1.5 By creating an account, the user creating the account accepts these general terms and conditions.

2.1.6 Blue-mobility reserves the right, without giving any reason and at its sole discretion, to refuse the creation of an account at all times.

2.1.7 Upon creation of a private account, an agreement is concluded—following approval by Blue-mobility—between the user who created the account and Blue-mobility. This user shall be considered the contracting party vis-à-vis Blue-mobility.

2.1.8 Upon creation of a business account, an agreement is concluded—following approval by Blue-mobility—between the organisation represented by the user who created the account and Blue-mobility. The organisation shall then be considered the contracting party vis-à-vis Blue-mobility.

2.1.9 The contracting party shall be liable for payment of any costs arising from the use of Blue-mobility’s services via the account, sub-accounts or vouchers created under the account in question.

2.1.10 The contracting party shall act as guarantor for any use of a Blue-bike via any sub-account or voucher created under the account. They shall be fully liable vis-à-vis Blue-mobility for both the rental costs and any failure by the user to comply with the obligations, in particular those set out in Articles 2.7 and 2.8 of these general terms and conditions, as well as for any harmful consequences for Blue-mobility resulting therefrom. Blue-mobility nevertheless reserves the right to recover any costs resulting from non-compliance with these general terms and conditions from the user who rented the Blue-bike.

2.1.11 When creating a private or business account a payment agreement shall be concluded. The payment agreement shall indicate the payment method agreed between Blue-mobility and the contracting party for the payment of any costs related to the use of Blue-mobility’s services.

2.1.12 In the event of non-payment by the contracting party or misuse by users linked to the private or business account, Blue-mobility may unilaterally delete the account (as well as any other accounts linked to it).

2.1.13 The contracting party declares that the information provided when creating the account is complete and correct and undertakes to keep this information up to date via the My-Blue-bike application or the Blue-bike app.

Failure to comply with this disclosure obligation shall specifically be considered a serious breach of these general terms and conditions and shall entitle Blue-mobility to refuse, immediately suspend or terminate the account concerned and to claim, by operation of law, a fixed compensation of EUR 225 from the contracting party.

Insofar as the contracting party qualifies as a consumer, this fixed compensation shall only apply to the extent permitted under mandatory consumer law and may be reduced by the competent court.
Blue-mobility also reserves the right to recover actual damage incurred as a result of a breach of the information obligation.

In the case of a business account, Blue-mobility reserves the right to recover such actual damage from both the contracting party and the user who created the account.

2.1.14 A business account may be requested by employees of companies, public authorities or organisations who are duly authorised to act as the legal representative of the relevant entity. If the person requesting the account proves not to be a valid legal representative of the relevant company, public authority or organisation and the latter disputes the validity of the account or the associated pricing formulas on that basis, any costs incurred by Blue-mobility as a result shall be recovered from the natural person who submitted the request. Blue-mobility nevertheless reserves the right to recover these costs from the relevant company, public authority or organisation if it is clear that Blue-mobility could reasonably assume that the person who created the business account was an authorised employee or legal representative of the relevant company, public authority or organisation.

2.2 Services offered by Blue-mobility under the Blue-bike brand and applicable conditions

2.2.1 Blue-mobility makes Blue-bike shared bicycles available to users at Blue-bike locations.

2.2.2 The bicycles can be unlocked by users via the Blue-bike app.

2.2.3 The Blue-bike app can be downloaded free of charge from the Google Play Store or the iOS App Store.

2.2.4 The user can rent a Blue-bike using the app after logging in with their account, or without an account by using a voucher or a MaaS ticket.

2.2.5 Blue-bikes can only be rented at Blue-bike locations and must also be returned to a Blue-bike location. When a bicycle is rented, Blue-mobility registers the start of the trip at the rental location. The trip can only be ended by terminating it in the app at a Blue-bike location.

2.2.6 A location may form part of a “Back-to-many” zone. Whether or not a location belongs to such a zone can be clearly consulted in the app.

2.2.7 A trip with a cargo bike must always be terminated at the location where the bicycle was rented. In the app, the user does not have the option to end a cargo bike trip at another location. If the bicycle is nevertheless left elsewhere and Blue-mobility has to return it to the starting location, a surcharge will be applied as set out on: www.blue-bike.be/en/pricing/

2.2.8 If the starting location is part of a Back-to-many zone, the user may end their trip with a city bike or e-bike at another location within the same zone without being liable for a surcharge.

In the following cases a surcharge shall apply upon termination of a trip:
A) if a trip with a city bike or e-bike starts at a location not belonging to a Back-to-many zone and ends at a location other than the start location;

B) if a trip with a city bike or e-bike is terminated in a location belonging to a different Back-to-many zone than the one in which it started

2.2.9 The user who registers an account shall automatically be assigned the administrator role for that account. A user holding the administrator role of a business account shall have the following additional functionalities:

  • to create and delete sub-accounts on behalf of their organisation;
  • to manage the pricing formulas of these sub-accounts;
  • to purchase vouchers

2.2.10 A sub-account is automatically created for a user who registers a business account.
Subject to consultation with Blue-mobility, the administrator role for a business account can be assigned to another or additional sub-account.

2.2.11 A company can make vouchers available to users associated with it via a QR code or a link. The user can then upload the voucher into the app and use it to rent a bicycle without having to create an account. Any costs resulting from the use of Blue-mobility services via a voucher shall be charged to the company that purchased the voucher.

2.2.12 Blue-mobility may also provide vouchers free of charge to private or business accounts as part of promotional campaigns or introductory offers. In such cases, any additional costs shall also be charged to the company or private account via the payment agreement of the account.

2.2.13 Blue-mobility has entered into agreements with various MaaS (Mobility-as-a-Service) providers to allow such providers to sell Blue-bike MaaS tickets to their customers.

2.2.14 A voucher has a limited validity period, which may be determined at the time of purchase.

2.2.15 The cost of a MaaS ticket and a voucher will depend on the type of bicycle that can be rented with it.

2.2.16 Cargo bikes cannot be rented by means of a voucher or MaaS ticket.

2.2.17 A voucher for an electric bicycle may also be used to rent a city bike but the additional cost of the electric bicycle voucher shall not be refundable.

2.2.18 The ride fare will be determined on the basis of the selected pricing formula, the type of bicycle (e-bike, city bike or cargo bike), the start and end location of the trip, the duration of the trip between the start and end time.

2.2.19 During a trip, the user may pause and temporarily lock the bicycle. This will not interrupt the duration of the trip.

2.2.20 The cost of the different pricing formulas and the associated ride fares are set out in the fare schedule and can be consulted in the app and on www.blue-bike.be. In the event of a dispute or ambiguity, the fares stated in the fare schedule on the website shall prevail over those displayed in the app.

2.2.21 The ride fares in the app are displayed per time block. For longer trips, the fare of the last displayed time block will apply to each new initiated time block of the same duration.

2.2.22 Blue-mobility distinguishes between locations that belong to a fare zone and locations that do not belong to a fare zone. If the location where a trip is started belongs to a fare zone, the fares of that zone shall apply for the trip based on its duration, the type of bicycle and the pricing formula selected by the user. If the start location does not belong to a fare zone, the standard fare shall apply.

2.2.23 Cities and municipalities may support the use of shared bicycles through a third-party payer scheme. In such cases, the city or municipality shall cover part of the ride fare for trips with the Blue-bike Member pricing formula. Where applicable, this discount will be displayed in the app in the pricing per location section.The third-party payer scheme may apply to all users or to specifically registered users, for instance under a social tariff.

Discounts on ride fires based on a third-party payer scheme applicable at the start location or based on a social tariff are automatically deducted.

2.2.24 Blue-mobility provides an SMS support service for users experiencing technical issues when renting a bicycle or during a trip: after sending an SMS, a Blue-mobility employee or an external partner will contact the user as soon as possible to provide assistance.

If the user cannot continue their trip due to a defect in the bicycle and is located at least 1.5 km from the rental location, they will be able to use Ethias bicycle assistance free of charge subject to the conditions set out on the Blue-bike website: https://blue-bike.be/ethiasbijstand

2.2.25 If the user does not make use of Ethias roadside assistance services, Blue-mobility will charge the additional cost for retrieving the bicycle.

2.2.26 Under any selected pricing formula, two Blue-bikes may be rented simultaneously at any time. The rental of a second Blue-bike is always charged (including under the Member Plus pricing formula), in accordance with the conditions set out in the tariff list.

2.2.27 The nature of the service, being a “shared bicycle”, implies that a Blue-bike shall preferably be rented for short periods (typically < 72 hours). In the absence of a response from the user after being contacted by Blue-mobility, the latter reserves the right to retrieve bicycles that exceed a rental period of 7 calendar days and return them to the starting location. The costs associated with this, together with any repair costs, shall be charged to the contracting party.

2.2.28 If the user retains the bicycle for 14 days or more after the first day of rental, the fixed surcharge as set out in the tariff list shall be due, unequivocally and by operation of law, by the contracting party to Blue-mobility in compensation for administrative costs and commercial loss incurred by Blue-mobility. Additional costs caused by damage to the bicycle, to third parties, or resulting from transport may be charged in addition to these costs. This shall also constitute a serious breach of these general terms and conditions and shall entitle Blue-mobility to immediately suspend or temporarily block the account and to charge a fixed compensation by operation of law as specified in the tariff list. This shall not deduct from Blue-mobility’s right to recover any actual damages incurred from the contracting party or the user.

2.3 Charging and payment of services provided by Blue-bike

2.3.1 When creating a private account via the app, only an electronic payment method can be selected, which is made available through the Adyen payment service provider integrated into the Blue-bike app.

2.3.2 Private accounts that, prior to the introduction of the payment service provider in the app (app version 2.0.0), paid by direct debit shall be able to retain this payment method, but can opt to switch to an online payment method.

2.3.3 Once the administrator of a private account has opted to pay via an online payment method, it shall no longer be possible to revert to direct debit as a payment method.

2.3.4 For business accounts, payment may be made via an online payment method, by direct debit, or by bank transfer upon receipt of the invoice.

2.3.5 The contracting party authorises Blue-mobility to collect any costs via the payment method provided by them in the form of a subscription service, without requiring further consent for each individual transaction.

2.3.6 The contracting party shall receive a monthly invoice containing an overview of any costs related to the use of Blue-mobility’s services via their account during the previous month, as well as the outstanding balance.

  • If the contracting party opts for payment by direct debit, the outstanding balance will automatically be collected from the specified account following receipt of the monthly invoice.
  • If the contracting party opts for payment by bank transfer, they must settle the invoice amount no later than the due date stated, into the bank account specified by Blue-mobility.

2.3.7 For online payments, all amounts due shall be collected immediately per transaction via the specified payment method.

2.3.8 In the event of a failed online payment, for example due to insufficient funds, an expired debit or credit card, or any other issue with the specified payment method, the private or business account will be immediately blocked and users will no longer be able to rent a Blue-bike via the account, its associated sub-accounts, or via vouchers purchased under the account until the outstanding amount has been settled.During an ongoing monthly billing period, the administrator may resubmit a failed online payment via the app. To this end, the app provides an overview of all failed online payments that can be resubmitted.

Before resubmitting a payment, the administrator can change the specified payment method.

If, after submitting the failed payment, there is no outstanding balance on the account, it will automatically be unblocked. Contracting parties who pay via the Adyen payment service provider will also receive a monthly invoice for overview purposes. Amounts collected via Adyen will be deducted from the outstanding balance on the invoice.

2.3.9 If the failed online payment is not successfully resubmitted during the ongoing billing period, the amount will appear as an outstanding and overdue balance on that month’s invoice. Blue-mobility reserves the right to temporarily block the relevant account until the outstanding and overdue balance has been settled by another means.

2.3.10 The contracting party shall be in default of payment if they fail to pay by the date stated on the invoice or statement, in accordance with the applicable payment method. If the contracting party does not pay, or if the direct debit cannot be executed, they will receive a reminder from Blue-mobility. Regardless of the chosen payment method, the amount must then be paid by bank transfer.

2.3.11 After receiving the reminder, the contracting party must rectify the situation within 14 working days. If the situation is not rectified within this period, Blue-mobility reserves the right to block the account.

2.3.12 Reminder fees:

The following reminder fees will be charged:

2.3.12.1 For business accounts:
Payments received after the first reminder shall automatically and without prior notice give rise to interest at a rate of 2.5% per month, as well as (also by operation of law and without prior notice of default) a fixed compensation of 10% of the invoice amount as a penalty clause, with a minimum of EUR 75.

2.3.12.2 For private accounts:
If the private account does not comply with the first reminder as referred to in Article 2.3.10, interest and a fixed compensation shall be charged within 14 days of sending the reminder. Interest will be charged at a rate of 10.5% per annum on the outstanding balance, in addition to the legally determined fixed compensation calculated as follows (in accordance with the Act of 4 May 2023 introducing Book XIX “Consumer Debts” into the Code of Economic Law):

  • For an outstanding amount of up to €150: €20;
  • For an outstanding amount between €150.01 and €500: €30 + 10% of the amount due on the share between €150.01 and €500;
  • If the outstanding amount exceeds €500: €65 + 5% of the amount due on the share above €500, capped at €2,000.

2.4 Use of Promo Codes

2.4.1 Any promo code applicable to one or more of the available pricing formulas, provided by Blue-mobility or a partner organization contractually affiliated with Blue-mobility, can only be used during the first year in which the pricing formula is taken out. In any case, only one promo code per account or sub-account and per selected pricing formula may be used, even if the account administrator was in possession of multiple promo codes (from different partner organizations) issued by Blue-mobility.

2.4.2 If a valid promo code is used, Blue-mobility will automatically deduct the amount allocated as a discount on the fixed costs of the “Member” or “Member Plus” pricing formula, and/or the ride fare

2.5 Automatic Renewal of Pricing formulas

2.5.1 The pricing formula selected for a Blue-bike account or sub-account shall automatically be renewed for the same period as the expiring term, in accordance with the general terms and conditions and the tariff list applicable at the time of renewal. This renewal shall automatically be applied unless Blue-mobility, on the one hand, or the administrator, on the other hand, specifically terminates the selected pricing formula no later than the day before the expiry date, or if the administrator has indicated that they wish to switch to another pricing formula. The administrator of a business or private account can modify or terminate pricing formulas via the My Blue-bike application or the Blue-bike app. Pricing formulas of sub-accounts can be modified or terminated by the administrator via the business portal (my.blue-bike.be). In the event of termination by Blue-mobility, the administrator of a business or private account will be notified via the e-mail address registered for the account.

2.6 Blue-mobility obligations

2.6.1 Blue-mobility undertakes to make every reasonable effort at all times, as a prudent and reasonable operator, to guarantee the availability of a Blue-bike shared bicycle to the extent possible at any Blue-bike location. This standard constitutes a best-efforts obligation on the part of Blue-mobility.
Nevertheless, our services may not be available 24/7. Situations may arise in which our services are interrupted, delayed, or unavailable, including but not limited to planned or unplanned maintenance, upgrades, urgent repairs, or force majeure caused by a third party. Blue-mobility reserves the right to partially or completely suspend the services where necessary to protect its legitimate interests, including but not limited to the continuity of the service and the correct functioning of the service and infrastructure, etc.

Blue-mobility shall not be responsible and shall not be held liable for any indirect damage incurred by a Blue bike user as a result of temporary unavailability of Blue-bike shared bicycles at a Blue-bike location or of the technology required to rent the bicycles.

2.6.2 The availability of a cargo bike at a given location is not guaranteed.

2.6.3 The best-efforts obligation to ensure the availability of a bicycle at each location is independent of the type of bicycle. We cannot guarantee that the desired bicycle type (city bike or e-bike) will be available.

2.6.4 Blue-mobility shall ensure that users are provided with a Blue-bike shared bicycle that is in good and safe condition and complies with legal requirements.

2.6.5 Blue-mobility makes every effort to ensure that the Blue-bike app functions on a wide range of devices but shall not be held responsible if the app does not function on a user’s specific device. The Blue-bike app relies on the GPS and Bluetooth functionality of the user’s device. At start and stop locations, the user’s device must be able to connect to the internet. Some features are hardware-based (e.g. GPS, Bluetooth, internet connection, etc.), others are software-based (e.g. app widgets), and some depend on the platform version. Not all devices support all features, which may result in the app not functioning properly on a specific device.

2.6.6 Blue-mobility shall ensure that batteries on e-bikes and cargo bikes are regularly recharged. The range indicated for a given battery level is purely indicative. Blue-mobility shall not be held liable if the full indicated range cannot be achieved with assistance, as this may vary depending on external conditions such as temperature, wind, rider or load weight, terrain inclines, etc. Blue-mobility cannot guarantee that e-bikes or cargo bikes with a fully charged battery will always be available.

2.7 User obligations

2.7.1 Before using the bicycle the Blue-bike user shall perform a basic visual inspection of the bike and report any clearly visible defects to Blue-mobility via the Blue-bike app. In exceptional cases, defects may be reported by e-mail (info@blue-bike.be) or SMS (8686).

2.7.2 After using a Blue-bike shared bicycle equipped with a digital lock, the user must return the bicycle to a Blue-bike location, terminate the trip via the app and physically lock the bicycle. The user must leave the bicycle in the same working condition as it was when collected, it being understood that the user shall be deemed to have received it in good condition and to have used it in a reasonable and prudent manner.

2.7.3 The Blue-bike user has the right to return the bicycle free of charge to the Blue-bike location where it was rented within 4 minutes of collecting it, if the bicycle shows a defect that is not attributable to the user. The user shall not knowingly ride a defective bicycle.

2.7.4 The Blue-bike user shall use the bicycle with due care and attention. This includes respecting traffic laws and the highway code, not endangering themselves or others, and only using the Blue-bike on suitable terrain/surfaces. The Blue-bike may not be used for racing, mountain-biking, stunts or tricks, nor to cycle through water (other than normal traffic), etc.

2.7.5 The user shall not carry loads exceeding 10 kg in the basket of the Blue-bike. They shall transport the load in a safe manner, which does not compromise the correct and safe operation of the Blue-bike.

2.7.6 When parking, the user must always lock the Blue-bike. For bicycles equipped with a digital lock, the trip must be paused in the app after which the frame lock of the digital lock mounted on the bike must be closed. If a Blue-bike is found unattended and unlocked, it may be confiscated by Blue-mobility or one of its agents. The contracting party shall be notified accordingly as soon as possible, and any associated costs shall be charged to the contracting party.

2.7.7 Under no circumstances shall the user make any modifications to the Blue-bike. Dismantling, modifying or tampering with any parts—except for adjustment of the saddle height—shall constitute a serious breach of these general terms and conditions and shall entitle Blue-mobility to immediately suspend or temporarily block the relevant account and to charge, by operation of law, a fixed compensation of EUR 225. This shall not detract from Blue-mobility’s right to recover any actual damages incurred.

2.7.8 Blue-bike city bikes and e-bikes are intended to be used by one person only and must not be used to transport other people.Blue-bike cargo bikes can only be used to transport maximum two people, in addition to the driver, provided that their combined total weight does not exceed 80 kg.

2.7.9 Blue-bike city bikes or e-bikes can be used by a minor, provided that they are at least 14 years old and that they are always used subject to their parents’ or legal guardian’s responsibility. Blue-bikes are not accessible to minors under the age of 14, even if accompanied by an adult.If Blue-mobility identifies a breach of this provision, the contracting party shall be held liable for any damage resulting from such unlawful use, vis-à-vis any third party. This shall also constitute a serious breach of these general terms and conditions and shall entitle Blue-mobility to immediately suspend or temporarily block the account and to charge, by operation of law, a fixed compensation of EUR 225. This shall not detract from Blue-mobility’s right to recover any actual damages incurred.

The Blue-bike user declares that they are in good physical condition and comply with any legal requirements to operate the relevant Blue-bike.

2.7.10 Users of a Blue-bike cargo bike must be at least 18 years old.

2.7.11 If the user chooses to use the mobile phone holder or bicycle basket, they acknowledge and understand that:

  • Blue-mobility shall not be responsible and/or shall not be liable for any loss or damage to the user’s mobile phone resulting from the use of the phone holder;
  • the use of the phone holder shall be at the user’s own risk;
  • the use of the bicycle basket shall be at the user’s own risk and Blue-mobility shall not be responsible or liable for any damage to, or loss of, personal belongings placed in the basket.

2.7.12 When using an e-bike or cargo bike, it shall be the user’s responsibility to check, at the start of the trip, whether the battery level is sufficient for the intended trip distance.

2.7.13 When using an e-bike or cargo bike, the user shall not be permitted to recharge the battery themselves or to have it recharged by a third party.

2.7.14 The use of an e-bike or cargo bike implies acceptance of the specific characteristics associated with “electrification”. This includes but is not limited to complying with any relevant traffic rules at all times, maintaining an appropriate speed, exercising caution when steering, and dismounting and walking with the bicycle where required depending on traffic conditions.

2.7.15 When using a cargo bike:

  • the user shall be responsible for using seat belts when transporting children;
  • it shall not be acceptable to carry loads exceeding 80 kg in the cargo area;
  • the user shall ensure that they start in a low gear and with an appropriate assistance level to prevent damage to the bicycle;
  • the user shall adjust the level of assistance according to the relevant situation, e.g. the load and terrain;
  • the user shall use the stand correctly and park the bicycle on a flat and stable surface;
  • the user shall ensure that they remain in control of the bicycle at all times, taking into account their riding experience and the specific characteristics of a cargo bike, including mounting, dismounting, riding, parking, loading and unloading.

2.8 Damage to the Blue-bike shared bicycle and repairs, loss and theft

2.8.1 Whenever a Blue-bike is damaged during a period of use, both the contracting party and the user shall be jointly and severally liable. Blue-mobility shall notify the administrator of the account in writing by e-mail of the nature of the damage and the total cost of the repair. The contracting party shall then have seven days to submit any objections to the claimed amounts in writing or by e-mail. If the contracting party fails to respond, Blue-mobility shall charge the repair costs to the contracting party.

2.8.2 Under no circumstances shall the user carry out repairs on the Blue-bike themselves or have repairs carried out by a third party. Any repair carried out in violation of this provision or not in accordance with the requirements shall be charged to the contracting party. This shall also constitute a serious breach of these general terms and conditions and shall entitle Blue-mobility to immediately suspend or temporarily block the account and to charge, by operation of law, a fixed compensation of EUR 225. This shall not detract from Blue-mobility’s right to recover any actual damages incurred.

2.8.3 The user must report any defect or damage to the Blue-bike identified during the trip to Blue-mobility as soon as possible in accordance with the procedure described in Article 2.7.1. When terminating a trip in the app, the user is always given the option to report a defect.

2.8.4 In the event of loss or theft of the Blue-bike, the contracting party shall be liable, throughout the entire rental period, for any damage incurred by Blue-mobility, as a minimum up to the amounts set out in the tariff list per incident and per Blue-bike. If the actual damage incurred by Blue-mobility exceeds the amounts specified in the tariff list, Blue-mobility reserves the right to charge the full amount of the actual damage.

2.8.5 However, in the event of theft, the contracting party’s contractual liability shall be limited to the amount corresponding to the “deductible” (own risk) as set out in the tariff list, provided that they can prove that the Blue-bike was locked using the ring lock attached to the bicycle. For a bicycle equipped with a digital lock, the user must have paused the bicycle via the app and this action must be traceable in the trip logs in Blue-mobility’s systems. In all cases, the user must provide Blue-mobility with confirmation of the theft report. The ongoing rental period shall only be terminated, at the earliest, at the time when Blue-mobility is notified of the theft and has received the theft report.

2.9 Complaints

2.9.1 Any complaint must be submitted in a timely manner and in writing to Blue-mobility, Provinciestraat 53, 2018 Antwerp, or by e-mail to info@blue-bike.be, stating “Complaint” in the subject line.

2.9.2 Complaints submitted within one month of the date of the incident giving rise to the complaint shall be considered timely. For complaints submitted in writing, Blue-mobility shall provide a written response within four calendar weeks or, within that same period, notify the complainant of the reasonable time required to respond. This communication may also include a request for additional information and the submission of more detailed supporting evidence, which, in the opinion of Blue-mobility, is necessary to formulate a response. If the parties fail to reach an agreement regarding the resolution of the complaint, the most diligent party may refer the matter to the competent court in the judicial district where Blue-mobility has its registered office.

2.10 Privacy policy

2.10.1 Blue-mobility safeguards the privacy of its customers and, in this regard, shall always act in accordance with the provisions of the General Data Protection Regulation (GDPR 2016/679 of 27 April 2016).

2.10.2 By using Blue-bike services via a private account or via a sub-account of a business account, the user agrees that their personal data will be processed in accordance with the Privacy Policy available on the Blue-bike website: blue-bike.be/en/privacy-policy

2.11 Changes to the general terms and conditions and tariffs

2.11.1 Blue-mobility NV reserves the right to amend these general terms and conditions, prices and services in response to necessary future developments, changes in the shared bicycle market and evolving economic conditions. Blue-mobility undertakes to notify the contracting party of such changes in a timely manner.

2.11.2 The contracting party has the right to terminate their account, the associated sub-accounts and pricing formulas as of the date on which the amended conditions enter into force if such changes affect the essence of the service and the associated obligations to such an extent that it can no longer reasonably be expected that the contracting party would continue to use Blue-mobility’s services under these conditions.

2.11.3 Changes to the general terms and conditions, pricing, the technologies offered for rental or the Blue-bike locations, as well as the potential early termination of a selected pricing formula, shall under no circumstances give rise to any refund of a pricing formula already subscribed to, any fixed fees already paid, or any amounts due for trips still in progress or not paid for. All pricing formulas shall be charged at the rates applicable on the date of activation, and trips shall always be charged at the rate applicable on the date on which the trip is started.

2.12 Right of withdrawal

2.12.1 If the contracting party is a consumer, they have a right of withdrawal of 14 days from the start date of the selected pricing formula. In accordance with Article VI.53, 1° of the Belgian Code of Economic Law, the contracting party loses this right of withdrawal if the Blue-bike services have already been used at the time they exercise their right of withdrawal.

2.12.2 To exercise their right of withdrawal, the contracting party must notify Blue-mobility of their decision before the expiry of the withdrawal period. To do so, they may send an unequivocal statement to cancel the pricing formula. This statement must be sent to info@blue-bike.be clearly stating ‘withdrawal’ in the subject line.

2.13 Force majeure

2.13.1 Blue-mobility shall not be liable for any loss, damage, failure or defects caused by events beyond its control, including but not limited to connectivity issues, power outages, vandalism, riots, fire, flooding, severe weather conditions, explosions, epidemics, pandemics or pandemic emergencies, war, sabotage, governmental measures, changes in laws and regulations, administrative procedures and other local regulations.

2.14 Applicable law and jurisdiction

2.14.1 These general terms and conditions shall be governed exclusively by, and interpreted in accordance with, Belgian law. No effect shall be given to any choice of law, conflict-of-law rule or provision (whether of Belgian, foreign or international law) that would result in a different interpretation of this agreement. This legal clause shall not affect mandatory provisions regarding consumer rights. Any disputes arising out of or in connection with this agreement, which the parties cannot resolve amicably, shall be subject to the exclusive jurisdiction of the courts of the judicial district of Antwerp, Antwerp division (Belgium)

2.15      General provisions

2.15.1 If any provision of these general terms and conditions is found to be wholly or partially unlawful, invalid or unenforceable under any applicable law, that provision shall be deemed not to form part of these general terms and conditions and shall not affect the legality, validity or enforceability of the remaining provisions. In such cases, Blue-mobility shall also make every effort to promptly and in good faith replace the invalid provision with a legally valid one.

2.15.2 These general terms and conditions, together with the documents referred to herein, constitute the comprehensive agreement between the parties with respect to their subject matter and contain everything agreed between them. They replace and supersede any prior agreements, communications, offers, proposals or correspondence between the parties, whether oral or written, relating to the same subject matter.

2.15.3 Any waiver, assignment or delegation of any condition, provision, right or authorisation granted under or pursuant to these general terms and conditions by the contracting party shall only be valid if made in writing and signed by Blue-mobility, and only for the specific situation and purpose for which such waiver is granted. Any attempt at transfer without the prior written consent of Blue-mobility shall be null and void.

2.15.4 Blue-mobility NV shall be entitled to assign, transfer or delegate its rights or obligations to a third party without the prior consent of the contracting party. In such cases, the contracting party shall have the right to terminate their account and the associated pricing formula in accordance with the provisions of Article 2.11 of these general terms and conditions.

2.15.5 Any failure or delay by Blue-mobility in exercising any right, power or remedy provided by law or under these general terms and conditions shall not in any way prejudice the continued exercise of such right, power or legal remedy, nor shall it be deemed a waiver thereof. Any single or partial exercise of any right, power or remedy provided by law or under these general terms and conditions shall not preclude any other or further exercise of that or any other right, power or legal remedy. Only specific written confirmation by Blue-mobility shall render a breach of any provision of this agreement without effect.
